Terms and Conditions

These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding and enforceable contract between you (“User”, “you”, or “your”) and Local Uncle, a technology platform operated as a product and brand of Kvantum Tech, having its principal place of business in Chandigarh, India, hereinafter referred to as “Local Uncle”, “Company”, “we”, “our”, or “us”.

By accessing, browsing, registering on, downloading, installing, or otherwise using the Local Uncle website and/or mobile application, including any features, functionalities, tools, or services provided thereon (collectively, the “Platform”), you acknowledge, agree, and affirm that you have read, understood, and voluntarily accepted these Terms, without limitation or qualification.

1. PLATFORM NATURE, ROLE, AND DISCLAIMER

Local Uncle is a technology-enabled online marketplace platform whose sole purpose and function is to facilitate introductions, discovery, communication, and potential engagement between users seeking services and independent third-party service providers offering such services.

Local Uncle does not employ, engage, manage, supervise, direct, control, or otherwise assume responsibility for any service provider listed on or accessible through the Platform. All service providers operate as independent contractors and are not agents, employees, partners, or representatives of Local Uncle.

Local Uncle expressly disclaims all representations, warranties, assurances, or guarantees, whether express or implied, relating to service quality, service performance, safety, reliability, legality, timeliness, suitability, or outcomes of any services provided by service providers. Any engagement with a service provider is undertaken solely at the user’s own risk and discretion.

2. ELIGIBILITY AND ACCOUNT ACCESS

To access or use the Platform in any capacity, you represent and warrant that:

You are between 18 and 60 years of age at the time of registration and use
All information provided by you is accurate, complete, current, and truthful
You have the legal capacity to enter into a binding agreement

Local Uncle reserves the absolute, unrestricted, and unilateral right to approve, deny, suspend, revoke, or terminate access to the Platform, in whole or in part, at any time, for any reason or no reason, with or without prior notice.

3. SERVICE PROVIDER VERIFICATION DISCLAIMER

Service providers listed on the Platform may undergo certain verification processes, which may include validation of phone numbers, Aadhaar cards, and one additional government-issued identification document.

Such verification is conducted solely for internal reference, administrative screening, and platform hygiene purposes and does not constitute endorsement, certification, recommendation, warranty, guarantee, or assurance of the service provider’s identity, background, skills, conduct, safety, reliability, or suitability.

Users acknowledge and agree that verification should not be relied upon as a substitute for independent judgment or due diligence.

4. USER OBLIGATIONS AND CONDUCT

By using the Platform, users agree to:

Use the Platform strictly in accordance with applicable laws, regulations, and these Terms
Refrain from engaging in abusive, harassing, fraudulent, deceptive, misleading, or harmful behavior
Avoid any activity that may disrupt, damage, or interfere with the Platform or other users
Independently assess, evaluate, and assume all risks associated with engaging a service provider

Local Uncle shall not be responsible for disputes, disagreements, or outcomes arising between users and service providers.

5. PAYMENTS, TRANSACTIONS, AND REFUNDS

Local Uncle does not currently facilitate, process, collect, hold, transfer, or manage payments of any kind through the Platform.

Any financial transactions, payments, fees, or compensation exchanged between users and service providers occur entirely outside the Platform and are solely between the respective parties involved.

Local Uncle bears no responsibility, liability, or obligation with respect to such transactions and expressly offers no refunds, reversals, or financial remedies of any nature.

6. USER-GENERATED CONTENT

Users may submit, upload, transmit, or otherwise make available content on the Platform, including but not limited to reviews, ratings, messages, images, or other materials (“User Content”).

By submitting User Content, users grant Local Uncle a perpetual, irrevocable, royalty-free, non-exclusive, worldwide license to use, reproduce, modify, adapt, publish, display, distribute, and utilize such content for platform operations, improvement, marketing, or promotional purposes, without further consent or compensation.

7. ACCOUNT SUSPENSION AND TERMINATION

Local Uncle reserves the right, at its sole discretion and without prior notice, to:

Suspend or terminate any user account
Remove, restrict, or disable access to any content
Restrict or permanently block access to the Platform

Such actions may be taken if Local Uncle determines, in its sole judgment, that a violation of these Terms, misuse of the Platform, or any potential risk to the Platform or its users exists.

8. LIMITATION OF LIABILITY

To the maximum extent permitted under applicable law, Local Uncle, its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the use of, inability to use, or reliance upon the Platform or any services accessed through it.

9. DISPUTE RESOLUTION AND ARBITRATION

All disputes, claims, or controversies arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively through private, binding arbitration conducted in India, in accordance with applicable arbitration laws.

Users expressly waive the right to initiate or participate in any court proceedings, class actions, or jury trials, except where such waiver is prohibited by law.

10. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by, construed, and interpreted in accordance with the laws of India, without regard to conflict of law principles.
